Weil Strafen oft mit der Zufügung erheblichen Leidens einhergehen, sind sie rechtfertigungsbedürftig. In diesem Buch wird die in der Philosophie seit jeher thematisierte Frage nach der Rechtfertigung staatlichen wie sozialen Strafens erneut gestellt. Klassische philosophische Positionen zum Problem der Strafrechtfertigung werden kritisch rekonstruiert, um diejenigen (...) Explainable artificial intelligence (XAI) seeks to produce explanations for those machine learning methods which are deemed opaque. However, there is considerable disagreement about what this means and how to achieve it. Authors disagree on what should be explained (topic), to whom something should be explained (stakeholder), how something should be explained (instrument), and why something should be explained (goal). In this paper, I employ insights from means-end epistemology to structure the field. According to means-end epistemology, different means ought to be (...) rationally adopted to achieve different epistemic ends. Applied to XAI, different topics, stakeholders, and goals thus require different instruments. I call this the means-end account of XAI. The means-end account has a descriptive and a normative component: on the one hand, I show how the specific means-end relations give rise to a taxonomy of existing contributions to the field of XAI; on the other hand, I argue that the suitability of XAI methods can be assessed by analyzing whether they are prescribed by a given topic, stakeholder, and goal. This paper studies efficient learning with respect to mind changes. Our starting point is the idea that a learner that is efficient with respect to mind changes minimizes mind changes not only globally in the entire learning problem, but also locally in subproblems after receiving some evidence. Formalizing this idea leads to the notion of uniform mind change optimality. We characterize the structure of language classes that can be identified with at most α mind changes by some learner (not necessarily (...) effective): A language class L is identifiable with α mind changes iff the accumulation order of L is at most α. Accumulation order is a classic concept from point-set topology. To aid the construction of learning algorithms, we show that the characteristic property of uniformly mind change optimal learners is that they output conjectures (languages) with maximal accumulation order. We illustrate the theory by describing mind change optimal learners for various problems such as identifying linear subspaces and one-variable patterns. (shrink)

As its title indicates, this book is concerned with two different fields of philosophy, ethics and epistemology. The bulk of the argument is devoted to epistemological questions, as these arise within the context of morality. Hence, the conclusions I reach could probably best be described as prolegomena to the elaboration of a theory of ethics. This article, based on a desk study, connects African spirituality to the phenomenon of poverty and argues that mundane poverty alleviation strategies that ignore the cultural perspective of a people are doomed to fail, especially in the African context. Within this context, a domain such as transcendence is as ‘real’ to the people as the material world. This article delves into the alchemy of the traditions of African people from a Zimbabwean perspective in an attempt to understand some of the (...) causes of poverty. The authors aver that development practitioners stand to gain if they take into account such (African) worldviews. The article shows that there is a disconnect between western culture and indigenous cultural beliefs and suggests that it is necessary to use phenomenological methods to unpack this disconnect because the spiritual world can support or limit the extent to which poverty alleviation programmes are effective. This means that the notion of development rooted in western knowledge frames may require opening discourses that imagine different social ontologies to find solutions in an (African) context. Thus, the challenge for phenomenologists is to research culturally-appropriate approaches to development using phenomenology. (shrink)

Family Values shows how the various contradictions at the heart of Western conceptions of maternity and paternity problematize our relationships with ourselves and with others. Using philosophical texts, psychoanalytic theory, studies in biology and popular culture, Kelly Oliver challenges our traditional concepts of maternity which are associated with nature, and our conceptions of paternity which are embedded in culture. Oliver's intervention calls into question the traditional image of the oppositional relationship between nature and culture, maternal and paternal. Family (...) Values also undercuts recent returns to the rhetoric of a "battle between the sexes" by analyzing the conceptual basis of these descriptions in biological research and the presuppositions of such suggestions in philosophy and psychoanalysis. C. S. Peirce's indictment that "the chief cause of [metaphysics'] backward condition is that its leading professors have been theo (Collected Papers 6:3) falls heavily at my door. For it logians" was out of reflection upon religious experience and its meaning that the present relational metaphysic was conceived. My hope, however, is that its scope is sufficiently wider than its theological origins to justify its appearance as a work in philosophy. Having been nurtured in existential philosophy and having reached some (...) measure of maturity with the wise counsel of Professor Dr. Fritz Buri, of Basel, I came to feel that theology as a modern discipline had reached an impasse owing to its overextended commitments to a subject-object paradigm of thought. Even those theologians who despaired of these ties seemed unable to find an independent alternative idiom for their ideas. A second tension in my thinking resulted from the inordinate neglect by theologians of the natural world. Also, my natural interest in physical understanding seemed unfulfilled within the narrow confines of theology, even of philosophical theology as then practiced. As I turned decisively toward the study of modern physics, and especially of cosmology, a new world seemed to open up to me. After extensive study with prominent astronomers and physicists, it began to dawn on me that the new physics has devised conceptual paradigms of thought which could be generalized into a metaphysical system of universal interest. From one perspective, the fundamental notions of point-set topology have to do with sequences (of points or of numbers) and their limits. A broad class of epistemological questions also appear to be concerned with sequences and their limits. For example, problems of empirical underdetermination–which of a collection of alternative theories is true–have to do with logical properties of sequences of evidence. Underdetermination by evidence is the central problem of Plato’s Meno [Glymour and Kelly 1992], of one of Sextus Empiricus’ many (...) skeptical doubts, and arguably it is the idea in Kant’s antinomies, for example of the infinite divisibility of matter [Kelly 1995, Ch.3]. Many questions of methodology, or of the logic of discovery, have to do with sequences and their limits, for example under what conditions Bayesian procedures, which put a prior probability distribution over alternative hypotheses and possible evidence and form conditional probabilities as new evidence is obtained, converge to the truth ([Savage 1954], [Hesse 1970], [Osherson and Weinstein 1988], [Juhl 1993]). Some analyses of “S knows that p” seem to appeal to properties of actual and possible sequences of something–for example Nozick’s proposal that knowledge of p is belief in p produced by a method that would not produce belief in p if p were false and would produce belief in p if p were true. Even questions about finding the truth under a quite radical relativism, in which truth 1 depends on conceptual scheme and conceptual schemes can be altered, have been analyzed as a kind of limiting property of sequences [Kelly et al. 1994]. This paper analyzes the notion of a minimal belief change that incorporates new information. I apply the fundamental decision-theoretic principle of Pareto-optimality to derive a notion of minimal belief change, for two different representations of belief: First, for beliefs represented by a theory – a deductively closed set of sentences or propositions – and second for beliefs represented by an axiomatic base for a theory. Three postulates exactly characterize Pareto-minimal revisions of theories, yielding a weaker set of constraints than the (...) standard AGM postulates. The Levi identity characterizes Pareto-minimal revisions of belief bases: a change of belief base is Pareto-minimal if and only if the change satisfies the Levi identity (for “maxichoice” contraction operators). Thus for belief bases, Pareto-minimality imposes constraints that the AGM postulates do not. The Ramsey test is a well-known way of establishing connections between belief revision postulates and axioms for conditionals (“if p, then q”). Pareto-minimal theory change corresponds exactly to three characteristic axioms of counterfactual systems: a theory revision operator that satisfies the Ramsey test validates these axioms if and only if the revision operator is Pareto-minimal. Kant taught us that there are two kinds of norms: Categorical imperatives that one ought to follow regardless of one's personal aims and circumstances, and hypothetical imperatives that direct us to employ the means towards our chosen ends. Kant's distinction separates two approaches to normative epistemology. On the one hand, we have principles of "inductive rationality", typically supported by considerations such as intuitive plausibility, conformity with exemplary practice, and internal consistency. On the other hand, we may assess rules for forming (...) belief by how well they attain the objectives that motivate inquiry; in Levi's words, "the ends of inquiry control the legitimacy of inferences" [Levi 67, p. 241]. A doctrinaire attitude would ignore one of these perspectives in favour of the other; a balanced approach is to develop both and compare [cf. Helmann 97, Sec.2]. The function and legitimacy of values in decision making is a critically important issue in the contemporary analysis of science. It is particularly relevant for some of the more application-oriented areas of science, specifically decision-oriented science in the field of regulation of technological risks. Our main objective in this paper is to assess the diversity of roles that non-cognitive values related to decision making can adopt in the kinds of scientific activity that underlie risk regulation. We start out, first, by (...) analyzing the issue of values with the help of a framework taken from the wider philosophical debate on science and values. Second, we study the principal conceptualizations used by scholars who have applied them to numerous case studies. Third, we appraise the links between those conceptualizations and learning processes in decision-oriented science. In this, we recur to the concept of methodological learning, i.e., learning about the best methodologies for generating knowledge that is useful for science-based regulatory decisions. The main result of our analysis is that non-cognitive values can contribute to methodological improvements in science in three principal ways: as basis for critical analysis, for contextualizing methodologies, and for establishing the burden of proof. Sensen analyzes Kant’s justification of duties to oneself. Why does Kant say that duties to oneself have priority over other duties? Sensen concludes that there is a common idea behind the different formulas of the categorical imperative: the idea that our human capacities have a high importance. Kant’s ethics needs anthropology to derive concrete duties from this general idea.

Interpretation groups, which meet on a regular basis for jointly analysing qualitative data, are well-established in sociology and related disciplines. There are currently at least 71 interpretation groups in German-speaking countries, and there are more if one includes project teams, which meet on a regular basis for data sessions. Yet, there is relatively little knowledge based on empirical research about these groups and their practices. Inspired by studies on social sciences and humanities, this article examines how “good” interpretations are jointly (...) created in these groups. Prior studies underlined that social scientific methods are productive, i.e., performative. Following this lead, my study turns data analysis in qualitative research into an object of inquiry by investigating how interpretation groups work on textual data. More specifically, this article discusses how these groups negotiate different interpretative options and at the same time evaluate the quality of their results as well as the interpretation process as a whole. In this regard, the approach presented in this article also contributes to the growing literature on valuation and evaluation in science by focusing on communicative devices for valuing and evaluating interpretations. Ci sono molti metodi diversi nell’interpretazione delle Scritture, e del Corano in particolare, e questi tendono a lavorare con diverse teorie del significato. Dopo tutto, la questione è cosa un particolare testo significhi effettivamente, e abbiamo bisogno di una teoria su come risolvere tali questioni, specialmente quando ci sono evidenti difficoltà nella comprensione del testo. Le argomentazioni tendono a spaziare su quale teoria del significato dia più senso al testo, o funzioni più adeguatamente come teoria del significato. Un metodo che (...) non è stato adottato nel complesso è quello di vedere la questione almeno parzialmente come morale ed epistemologica. Dovremmo avere fiducia di poter comprendere interamente ciò che abbiamo davanti e come potremmo sapere di avere la risposta alle questioni semantiche che ogni testo porta con sé? Si potrebbe sostenere che un’etica della moderazione, dell’equilibrio e della moderazione sono importanti tecniche ermeneutiche che finora non sono state sufficientemente impiegate quando si discute su come comprendere e interpretare il Corano. There are many different approaches to interpreting scripture, and the Qurʾān in particular, and these tend to work with different theories of meaning. After all, the issue is what a particular text actually means, and we need a theory about how to resolve such questions, especially when there are apparent difficulties in understanding the text. Arguments tend to range over which theory of meaning makes most sense of the text, or works most adequately as a theory of meaning. One approach which has not been taken on the whole is to see the issue as partially at least moral and epistemological. Should we have confidence that we can understand entirely what is before us, and how would we know that we have the answer to the semantic issues that any such text brings along with it? It might be argued that an ethics of moderation, balance, and restraint are important hermeneutic techniques that up to now have not been sufficiently employed when discussing how to understand and interpret the Qurʾān. Although naming-and-shaming (shaming) is a commonly used tax enforcement mechanism, little is known about the efficacy of shaming tax evaders. Through two experiments, this study examines the effects of shaming tax evaders on third-party observers’ perceptions of retributive justice and tax compliance intentions, and whether the salience of persuasion of observers moderates these relationships. Based on insights from defiance theory, the message learning model, and persuasive communications, this study predicts and finds that shaming evaders increases observers’ tax compliance intentions. Furthermore, (...) the results show that higher persuasion, which includes sanction and normative appeals, affects observers’ tax compliance intentions. This study also suggests that shaming has a positive effect on perceptions of retributive justice. Importantly, the results reveal that perceptions of retributive justice in shaming punishment mediate the effect of shaming on tax compliance intentions. The effective collection and management of personal data of rapidly migrating populations is important for ensuring adequate healthcare and monitoring of a displaced peoples’ health status. With developments in ICT data sharing capabilities, electronic personal health records (ePHRs) are increasingly replacing less transportable paper records. ePHRs offer further advantages of improving accuracy and completeness of information and seem tailored for rapidly displaced and mobile populations. Various emerging initiatives in Europe are seeking to develop migrant‐centric ePHR responses. This paper highlights their (...) importance and benefits, but also identifies a number of significant ethical, legal and social issues (ELSI) and challenges to their design and implementation, regarding (1) the kind of information that should be stored, (2) who should have access to information, and (3) potential misuse of information. These challenges need to be urgently addressed to make possible the beneficial use of ePHRs for vulnerable migrants in Europe. (shrink)

Die Erarbeitung der „Funktionen des Lebendigen“ kann als ein vielschichtiges Arbeitsprogramm verstanden werden, mit dem eine zentrale Problemlage unserer Zeit, unserer Gesellschaft und unserer Technik erschlossen werden kann. In der Verbindung des methodologischen Begriffs der Funktion mit dem phänomenalen Begriff des Lebendigen liegt ein philosophisches, wissenschaftstheoretische und kulturreflexives Potential. Denn zum einen ist der Funktionsbegriff ein Schlüsselbegriff (...) im Diskurs der Moderne, gerade im Kontext von anthropologischen, lebensphänomenologischen und bioethischen Fragen. Und zum anderen stellt das Phänomen des Lebendigen nach wie vor eine der großen Herausforderungen für das philosophische Denken dar, sei es in ontologischer, anthropologischer oder ethischer Hinsicht.
